Shelby's New Challenge

The new amendment to Title 9, Chapter .04 of the Shelby Municipal Code, Ordinance no. 794 seeks to increase safety for those out walking in winter. But does it really bring about that benefit or does it just increase the blood pressure of in town property owners? The basics of the new ordinance are as follows: The ordinance gives property owners a maximum of 24 hours after a snowstorm ends to clear the sidewalk abutting the property and used by the public of snow greater in depth than one inch. Property owners also have a maximum of 24 hours to remove any snow pack, any ice, any slush, any mud and any other threat to safe foot travel. If, for some reason, the snow and or ice cannot be reasonably removed, the owner must apply sand or other abrasive material to the sidewalk to make foot travel reasonably safe and repeat as needed. Failure to comply will give the City of Shelby the right to remove such threats to safe foot travel and assess the cost against the property. This ordinance also states that no notice to the owner of the premises is required. This is a paraphrased reading of the full ordinance. This ordinance all sounds fine and good until you look closer and give it more thought. First, who is to decide if the snow or ice can or cannot be reasonably removed? How much sand or "other" abrasive is needed? Also, for the many walkway areas all over town that have no concrete and are just dirt or grass covered, removal of "any mud" as stated in the ordinance is impossible. Then the biggest issue is the streets. When someone is out walking, they almost always have to cross a street. The city is not placing the same need for safety there. Sure, the city has been making an effort to clear some snow from the streets but this past winter many streets had near to a foot of heavy packed snow and ice. Not all streets were ever cleared or sanded. Also, the city did put out some sand at busy intersections and up some streets, but the main basis for that is to help vehicle tire footing not pedestrian. Some sand under human foot can actually be like walking on kids marbles and cause one to slip and fall. Beyond the practical or in this case, the impractical, implementation of this ordinance is the headache and financial burden placed on the common property owner. If the city has as much trouble clearing the streets and alleys because of practical and financial reasons, how will it be for the property owners who are now expected to hold to a much, much higher level with their sidewalks??? This amendment does not address the issue it was intended to and thus is not helping the citizens of Shelby.

Discovery STS-119 Comes Home

CAPE CANAVERAL, Fla. – Shuttle Discovery and its crew of seven returned to Earth at 3:14 p.m. EDT on Saturday and successfully wrapped up a construction mission that left the international space station with all its solar wings and extra electrical power. Mission Control delayed Discovery's homecoming by about 90 minutes, or one orbit, because of windy, cloudy weather. But the wind shifted and conditions improved enough for the second and final landing opportunity of the day. Discovery's 13 day flight, which ended just as a new Russian-launched crew was settling into the space station, was highlighted by the installation and unfurling of the space station's last pair of solar wings. The $300 million addition brought the orbiting outpost up to full power, a vital part of NASA's plan to double the space station population and boost the amount of science research in a few months.
Excitement and a sense of accomplishment was evident among the Discovery crew members as they spoke with the media after landing today. Commander Lee Archambault introduced five of the seven members of the STS-119 mission crew. Mission Specialist Sandra Magnus remained at crew quarters accompanied by Richard Arnold. Archambault described the demanding mission that included three spacewalks to install the S6 truss increasing the electrical capability of the station, and how well space shuttle Discovery handled throughout the mission. "It was an exciting mission … and we're very happy to be back at the Kennedy Space Center," Archambault said. Archambault also mentioned the call from President Barack Obama and how honored the crew at the station was to speak with him and answer his questions. Mission Specialist Joseph Acaba said he was amazed at the views from the space station. "It was kind of surreal to look out the window and see your two buddies out there that you've been training with for a long time and see them out there…it was a special moment," said Acaba. As Pilot Tony Antonelli maneuvered Discovery away from the station other crew members snapped some amazing shots of the orbiting outpost that they said will stay with them for a long time. "We worked a long time training for this mission and I was so proud to be a part of it," said Mission Specialist Steve Swanson. The crew is expected fly back to Houston's Ellington Field Sunday. After arrival they'll be honored with a homecoming celebration for the successful STS-119 mission.

Toole County Sheriff's Report

This Report Updates Every Week


Friday, March 20-
12:25 a.m. - Officer received complaint that vehicle dumped garbage in lot on Treasure Ave.

10:17 a.m. - Received advice that male bought a train ticket with his girlfriend's credit card that she did not authorize. Train will be here between 11:30 and 11:45 a.m. Officer is out at train station and advises they took up a collection and he now has enough to buy a ticket to his destination.

12:10 p.m. - Female had a problem with a male last night and he just came over again. She says she is not in danger at this time and we advise if he comes back to call 911.

2:59 p.m. - Male advises he was teaching his daughter to drive a stick shift and she ran into the guardrail on frontage road. We advise MHP.

3:24 p.m. - Caller advises another male is trying to fight him. Officers are in the area and speak with kids involved. Officer spoke with the alleged aggressor but was not happy with outcome and will deal with him later.

7:30 p.m. - Officer at prison advises that the perimeter guard driver says there is a suspicious vehicle that has been driving around there; he will get the plate number when he next approaches it. This is a person who works there and she reports she is just waiting for her mother. We advise her to go and tell the perimeter guard what she is doing.

8:25 p.m. - Female asks if her son is in jail and we advise negative. She says he and his girlfriend are fighting again so she was concerned. Officers spoke with the brother of the son involved and told him his stuff is outside the girlfriend's house. Hopefully he will pick it up.

8:50 p.m. - Female called and asked if we could put an arrest order on someone. We advise we don't do that; the judge does that. We asked her what the complaint was and she said someone was trying to have sex with her and she doesn't want it. She advises the male is 40 and she is 19 and that they used to date two years ago but it is over and he won't leave her alone. He is making these requests over the phone as he lives in Michigan. We provided the number for the police department in that town so she can ask them to tell him to quit calling her. We called Michigan and they did receive a call from her but they also had a complaint on her last week as she called an assisted living place and harassed them. They also have a sexual misconduct case going on the male involved on a little girl. We advise if she wants a PTO she must contact the judge.

Saturday, March 21

2:02 a.m. - Officer reports he is out with a disturbance on Main Street. One male is transported to the Sheriff's office.

2:03 a.m. - Female advises she was in a local Main Street business when she was assaulted by a male. She says she does not need an ambulance. Advise Deputies and they advise two females are coming in to make a statement.

8:19 p.m. - Female called and wanted an officer to call her back. When asked what was going on she said a male had just threatened her daughter. He is supposedly getting a bunch of guys together at his house and going to her daughter's house. She said she was going to get her husband's gun and handle it herself. We told her she would just get in trouble for that and she should let us handle it. Deputy headed over to see if he could locate the males involved. We called the male, who did not answer, but we left a message to knock it off or he would find himself in jail. Deputy spoke with males and advised them to quit texting. He feels this is done for the night.

Sunday, March 22

6:18 p.m. - Male caller advises two boys were up on top of a yellow trailer behind the tire dealership and are throwing tires off of it. Deputy reports to the site and tells the boys to pick up the tires and get off the property.

7:39 p.m. - Employee at local convenience store advises they have a diesel spill of about 30 gallons. We page Shelby ambulance and fire department. Ambulance, fire department and command van all report to the site.

8:10 p.m. - Female caller advises there is a male in a jean jacket and pants with a hood stumbling out into traffic and she is afraid he is going to get hurt. Advise Deputy who says Glacier County Sheriff's Office just dropped this guy off west of Shelby. Deputy calls people who help with destitute individuals and he advises if we have the male come back in the morning he will get him on the bus.

8:22 p.m. - Officer advises there are two vehicles with flashers on I-15 just south of the prison if someone wants to check on them. Deputy reports and says there is a vehicle being towed on a trailer. There is defective equipment on the trailer but the flashers are going on the Jeep in tow.

Last week's report:
Friday, March 13-
8 a.m. - Caller advises there are two small children, a boy and a girl, the girl might be about a 1-year-old, playing out in traffic unsupervised by anyone.

She feels someone should check on them. Then she advises they just went back inside. She said they were out about 10 minutes. Officer checks with the mother of the children who states her 3-year-old son opened the door while she was in the shower and allowed her small daughter out into the yard. When asked if she had a dead bolt or chain she stated the boy opened the dead bolt and she was going to speak with the landlord regarding a chain that could be installed out of his reach.

9:43 a.m. - Caller would like an Officer to come out so he can file a report of trespass as people are running over locked gates and driving in the property. There is no suspect or vehicle description. Officer reports to the location and makes a report.

2:52 p.m. - Caller advises there is a big bag of something in the middle of the lane at the north exit to Shelby. Officer reports and removes the bag.

3:11 p.m. - Officer advises there are people walking around in the median and they have a camper parked. It looks as if they may have lost something off the camper. We advise an officer just picked up a bag of wood chips in the southbound lane north of the north exit to Shelby that could be what they lost. Officer goes back to see but they are gone when he returns.

5:01 p.m. - Mother reports her 8-year-old daughter is missing. She was to report to a friend's house after school but did not show up. Mother provides description of clothing the girl was wearing. Officer is unable to locate girl at the Shelby game. At 5:41 p.m. mother reports the girl has been located.

11:48 p.m. - Officer makes traffic stop and discovers that occupant of vehicle is a registered sex offender. Original stop was for defective equipment and driver will get the taillight fixed. Occupant of vehicle was told to check in with the office to make sure he is in compliance with registration for sex offender status. Citations issued for no seat belt, no insurance and expired registration.

Saturday, March 14

9:45 a.m. - Officer at local prison facility requests an officer to the perimeter of the prison to investigate what is believed to be a bag of marijuana found on a dash in someone's car in the parking lot. Officer advises he needs to obtain a permission to search form. Officer reports to prison and transports one adult female back to Sheriff's Office. Judge reports to arraign and orders a time pay. Took $50 for first payment and transported female back to prison.

10:11 a.m. - Caller advises that on Wednesday morning he saw a dog chasing his livestock so he shot and killed it. It was his neighbor's dog and they called Thursday night and threatened to kill his dog. Then Friday night the neighbor and his son came over and threatened and harassed them, left, then shot their dog and killed it. When asked why he did not report this last night he stated they did not know their dog was dead until this morning. Officers report to both residences and take statements.

1:29 p.m. - Caller advises her son is in collections because of an outstanding tow bill for $1,400 on a vehicle which her son has never heard of or seen. The address on the tow bill shows as his father's address in Shelby. Her son has never lived in Shelby and thinks this may be a case of ID theft.

9:05 p.m. - Male reports that some boys are threatening him to fight. Officer reports and finds that it was all verbal. Spoke with kids and parents.

Sunday, March 15

2 a.m. - Caller asks to speak with a Deputy regarding disturbing phone call she received from a male caller who seemed to know everything about her but she doesn't know who the guy is. Deputy advises he had spoken with three guys earlier who told him they were going to repossess the caller's vehicle. Deputy made contact with caller and she is content with the information she was given.

2:58 a.m. - Caller advises she and her friend had a falling out with some people and they dropped them off on a dirt road. They are barefoot and have been drinking. They were not certain where they were and, after many tries the police finally located them at 3:45 a.m.

3:48 a.m. - Caller advises she has three 18-year-olds with two pipes that tested positive for marijuana and multiple other pieces of paraphernalia as well as unopened beer in the vehicle. Officer reported to the Port and returned to Shelby with one male in custody for processing. The other two will be attempting to get bond for the one he has in custody. Subject cited for possession of dangerous drugs and possession of drug paraphernalia.

6:22 a.m. - Caller reports vandalism to a car in the hospital parking lot. Officers are looking for a suspect but are unable to locate subject. Officer took written statements, photographs and one rock as evidence.

8:39 a.m. - Caller advises he has a 17-year-old abusive child at his house who has taken a couple of swings at him. He says the child is in his bedroom now but wants officer there before he has to take matters into his own hands. He advises there are no weapons involved. Officers report and return with one juvenile in custody. We call Cascade County Juvenile Detention Center to check on bed status and juvenile will be taken there as his mother will not take him back in. She does not feel she will be able to control the child.

1:19 p.m. - Caller advises has vandalism to her mother's house and it must have just happened because it is paintball and still wet.

5:08 p.m. - Caller advises his wife is moving items from their residence and he wants an Officer there to make sure she doesn't take items belonging to him. Both parties report to the Sheriff's Office, then left and will return with property separations.

Mount Redoubt Volcano Erupts

Mount Redoubt, in Alaska, has erupted five times overnight, with an ash plume more than 9 miles into the air. Alaska's largest city has not yet seen falling ash, though some fine gray dust was falling Monday morning on some communities north of Anchorage. The ash began falling around daybreak and continued into the middle of morning. Alaska Airlines on Monday canceled 19 flights in and out of the Anchorage international airport because of the ash. The "ash" is actually super fine volcanic rock dust and is a very abrasive substance which can damage jet engines and even clog their function. The dust is also a big hazard to vehicles and extremely dangerous for animals and humans. Scientists have been watching Mount Redoubt all along knowing that even though its last eruption was nearly twenty years ago the volcano was set for more. 5380 Marijuana Pipes

U.S. Customs and Border Protection officers at the Sweetgrass, Montana Port of Entry this week state that they found 5,380 pipes commonly used to smoke marijuana. The truck containing the pipes was coming in from Canada and was picked out to be one randomly searched. A news release said the pipes were worth more than $284,000 and that documents showed that they were on the way to California, Texas and Florida. During the search it was determined that the shipment had suspicious paperwork. Customs and Border agencies said the seized shipment had a number of problems, including false invoicing, false marking, false names for the shipper and consignee, as well as being undervalued. Such items are also prohibited from being imported into the United States.

Revitalizing Shelby Business

Julie Burk, from the Montana Department of Commerce, met with: elected officials; the press; business owners and citizens last night to present and discuss ways that small communities can improve their business and social standing. The meeting was held at the Shelby City Hall from 5 PM to 8 PM with pizza and refreshments. Julie made her presentation with a laptop and a projection TV, helping the audience see the important data in images as she read. This meeting was a part of the National Trust Main St Center which was started in 1980 and which Montana joined in 2005. The organization works to promote ideas that really work for smaller communities rather than allowing those ideas that do not work to continue. One such example is the pedestrian mall concept. The mall is generally a section of a business street that has been closed off from part or all vehicle traffic. This is to make a walking and sitting area free of traffic with the thought that shoppers will gather and spend more time shopping. Julie explained that pedestrian malls have been shown to not work very well and most fail. Helena, Montana has one such pedestrian mall that struggles. A few shops there do well but most do not. Some of the key points made by Burk were: 1. organizing your community and businesses; 2. marketing them; 3. designing to appeal to shoppers and 4. working on economic restructuring. Mayor Larry Bonderud was keen on the economic restructuring part and made many statements about how Shelby is working on that issue. Those included the new local public bus terminal to be built in the old Hannah and Holems building to the west of Albertsons. When the floor was opened for comments most were about needing more Shelby shoppers. The issue of area citizens traveling to Great Falls to buy rather than shopping in Shelby was a large part of the discussion. Shelby Glass and Office Supply said that they have to sell at higher prices since they cannot compete with the big box stores. Another business person said that they would special order items for customers, if they would be patient for the item to arrive. Also discussed were: the need to get the word out about what all Shelby already has to offer: business building upgrades that do not cost a lot; appealing signs for businesses; being more neighborly to customers; a possible general Shelby business logo; more community volunteerism and business grants. Many other ideas were circulated and notes were taken.

Just a last minute notice... The City of Shelby is hosting a public meeting about the downtown revitalization plans. There are architectural drawings and presentations to be made. This should be a very interesting get-together and you can also meet us at NBMC there. Pizza and refreshments are scheduled to be served. The meeting is at the City Hall, 112 1st Street South from 5 PM to 8 PM this evening. NBMC will bring you more info after the meeting.

Sirens Blast For Yotes



The Shelby, Montana Coyotes (Yotes) and fans received a more than warm welcome on their return from State this afternoon. Waiting for them at the city limits was the Sheriff and Fire Departments. Upon entering the city, they had a Sheriff and Fire Department escort to Shelby High School. The Shelby Coyotes placed second at State after their game with Fairfield, Montana which ended 64 to 60, Fairfield. In other games, the Coyotes won against Missoula/Loyola, 65 to 56 and against Columbus, 67 to 60. All in all, the Coyotes have had a great season under Coach, Tom Reynolds.

Mini Monster Truck Rally

Late this afternoon there was a great example of "boys will be boys" when a small group organized an impromptu monster truck rally. Actually, this was more of a mini monster truck rally since the truck involved was smaller than the car it was crushing. We at NBMC just happened onto the festivities while out for a drive. When we arrived, the truck was up on the hood of the car and was stuck there. Fear not, for soon a large Dodge truck arrived with a chain and pulled the other off of the hood. Cameras were snapping including ours as the mini monster truck climbed back onto the car. This time crunching and smashing the windshield of that poor car... This became an even greater photo op including someone making a video. Again, the truck was not able to free itself from the car and the Dodge came to the rescue.

Keep Your Snow Shovel Out



The City of Shelby gave provisional approval at the first reading of an ordinance outlining the requirements for snow and ice removal by property owners within the city limits at their regular meeting on March 2.
The ordinance will give property owners a maximum of 24 hours after a snowstorm ends to clear the sidewalk abutting the property and used by the public of snow greater in depth than one inch. Property owners will also have a maximum of 24 hours to remove any snow pack, any ice, any slush, any mud and any other threat to safe foot travel.
If, for some reason, the snow and or ice cannot be reasonably removed, the owner must apply sand or other abrasive material to the sidewalk to make foot travel reasonably safe and repeat as needed.

T. Boone Pickens In Montana



Billionaire oilman, T. Boone Pickens, who has a been touring and touting his plan to reduce the USA dependence on imported oil, spoke in Helena on February 27th. Pickens was the keynote speaker at the Montana Ambassadors annual conference, “Energy Jobs for Montana”, held at the Great Northern Hotel. The presentation was at 10:30 a.m. followed by audience questions and noon luncheon. Gov. Brian Schweitzer signed the Pickens Pledge in September, saying he recognized a mutual interest in developing the state and nation’s new energy future, including our tremendous opportunity in renewables like wind power. A panel of energy developers and policy experts discussed the opportunities and challenges Montana faces in trying to bring energy projects to the state.

Highlights Of Explosion At Bozeman Mt

An explosion rocked downtown Bozeman last Thursday morning, collapsing at least three buildings and prompting evacuation of a two-block area, officials said. Reports indicate the explosion happened at about 8:15 a.m. in the 200 block of Main Street. Crews were working to extinguish a fire caused by the explosion. Boodles restaurant and bar were destroyed, KBZK-TV reported. A police dispatcher said the adjacent Rockin R bar was also destroyed. Police evacuated the two blocks surrounding the businesses, housed in brick buildings. Jason Shrauger with the Gallatin County Disaster and Emergency Services said it was unknown what caused the explosion or if there were any injuries.

It is now known that one woman died due to the explosion. She was working at a Bozeman art gallery at the time. The video below has a brief statement from Governor Brian Schweitzer.

Cafeteria Regular Leaves Wealth

A Costa Mesa, California fellow named Bruce Lindsay who seemed a "bit" more than frugal, recently passed away at the age of 79. His passing would not be making world news if it were not for his life and lifestyle. Mr. Lindsay, who grew up in the USA depression of the 20th century, made every penny count. He first was know to eat at a local hospital cafeteria to save money and later he found Vanguard University and their all-you-can-eat for $1.25 one. He ate there for decades until his passing and when he did pass he left Vanguard a special gift. Millions of $$$... You see, Bruce may have seemed cheap, but he had a great love for life and for people. Never having had his own children, Bruce loved to talk with and give advice to the college students at Vanguard. That advice was truly rock solid seeing as how Bruce had made his fortune as a careful business man. He would buy oil leases at reduced prices and also beach front real estate working them and often rolling them over to make his profits. Not to mention spending very little money along the way... A Bunch Of Cutups

The snow storm and frigid wind this evening did not stop the Shelby Volunteer Fire Department from emergency practice. After taking delivery on two wrecked cars at the new fire hall, one a sub-compact and the other a medium sized, the department got busy taking them apart. One car was upright and the other upside down, thus representing a two car crash. This practice session, like the one pictured above, was of pulling apart the autos and cutting them up with the "Jaws of Life." The Jaws of Life, shown below, can pop open crushed vehicle doors and slice through steel to free trapped persons in an accident.
